Definitions:

APP: Application developed for mobile devices, either paid or free, that can perform various activities.

WEBSITE: Internet page with content from companies or individuals.

NEXT SHIFT: The APP available on the App Store, along with related resources and tools.

USER: Individuals or legal entities who use and access the services provided by NEXT SHIFT.

PRO: The paid version of the NEXT SHIFT APP that offers exclusive features.

NEXT SHIFT is offered by BIVIS SERVIÇOS EM TECNOLOGIA LTDA - ME, Personal Data Controller.

1. Terms

By accessing NEXT SHIFT APP, the USER agrees to comply with these terms of service, all applicable laws and regulations, and agrees that they are responsible for complying with all applicable local laws. If the USER does not agree with any of these terms, they are prohibited from using or accessing this APP. The materials contained in NEXT SHIFT are protected by applicable copyright and trademark laws

2. Licenses

Permission is granted to use the NEXT SHIFT APP, and under this permission, the USER may not:

Modify or copy the materials;
Use the materials for any commercial purpose or for public display (commercial or non-commercial);
Attempt to decompile or reverse engineer any code contained in NEXT SHIFT;
Remove any copyright or other proprietary notations from the materials;
Transfer the materials to another person or "mirror" the materials on any other server.

This access permission will be automatically revoked if you violate any of these restrictions and may be terminated by NEXT SHIFT at any time.

3. Disclaimer

The features of NEXT SHIFT are provided 'as is.' NEXT SHIFT makes no warranties, express or implied, and with this disclaims and negates all other warranties, including, without limitation, implied warranties or conditions of merchantability, suitability for a particular purpose, or non-infringement of intellectual property or other rights.

4. Limitations

In no event shall NEXT SHIFT be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the features on NEXT SHIFT, even if NEXT SHIFT or a NEXT SHIFT authorized representative has been notified orally or in writing of the possibility of such damages. As some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to the USER.

5. Accuracy of Features

The features displayed in the NEXT SHIFT APP may include technical, typographical, or photographic errors. NEXT SHIFT may make changes to the features contained in the APP at any time without prior notice. However, NEXT SHIFT does not undertake to update the features.

NEXT SHIFT may at any time begin charging for the services provided, and the USER may choose to stop using the services.

6. Subscription and Paid Features

NEXT SHIFT APP offers additional and enhanced features available in the PRO version. These features may include, but are not limited to, access to premium resources, exclusive functionalities, and additional content.

PRO Subscription: The PRO version of NEXT SHIFT is available through a subscription. By opting for the PRO subscription, users will have continuous access to the premium features of the app during the active subscription period.

Billing and Payment: The billing for the PRO subscription will be processed by Apple in accordance with the policies and terms of service of the App Store. Users agree to provide valid payment information and authorize Apple to charge the corresponding amount for the PRO subscription from the provided payment method.

Automatic Renewal: The PRO subscription for NEXT SHIFT is set for automatic renewal unless canceled by the user. The automatic renewal will take place in the timeframe determined by Apple, unless the user cancels the subscription before the end of the current subscription period.

Cancellation of Subscription: Users can manage and cancel their PRO subscription for NEXT SHIFT at any time directly in the App Store account settings. Cancelling the subscription before the end of the current subscription period will not result in a full or partial refund of the amount paid.

7. Links to External Websites

NEXT SHIFT has not reviewed all the sites linked to its website and is not responsible for the content of any linked site. The inclusion of any link does not imply endorsement by NEXT SHIFT of the site. The use of any linked website is at the USER's own risk.

8. About the Privacy Policy

Your privacy is important to us. It is NEXT SHIFT's policy to respect the privacy of USERS regarding any information we may collect on the NEXT SHIFT APP and WEBSITE.

We request personal information only when we truly need it to provide you with a service. We do this by fair and lawful means, with your knowledge and consent. We also inform you why we are collecting it and how it will be used.

We only retain the information collected for as long as necessary to provide the requested service. When we store data, we protect it using commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use, or modification.

We do not publicly share personally identifiable information or with third parties, except when required by law.

Our APP may contain links to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites and cannot accept responsibility for their respective privacy policies.

The USER is free to refuse our request for personal information, understanding that we may not be able to provide some of the desired services.

8.1 USER Commitment

The USER agrees to make appropriate use of the content and information that NEXT SHIFT provides in the APP and:

Not to engage in activities that are illegal or contrary to good faith and public order;
Not to disseminate propaganda or content of a racist, xenophobic, gambling, or illegal pornography nature, nor to promote terrorism or violate human rights;
Not to cause damage to the physical (hardware) and logical systems (software) of NEXT SHIFT, its suppliers, or third parties, nor to introduce or disseminate computer viruses or any other hardware or software systems capable of causing the aforementioned damages.

9. Updates and Modifications

NEXT SHIFT may revise these terms and conditions at any time without prior notice. By using this APP, you agree to be bound by the current version of these terms and conditions.

10. Termination

These Terms are effective from the moment you accept them or when you first download, install, access, or use the APP, and will remain in effect until terminated as outlined below:

If you violate any provision of these Terms, your authorization to access the APP, as well as these Terms, will automatically terminate. Additionally, NEXT SHIFT reserves the right, at its sole discretion, to terminate these Terms or your account on the Service, or to suspend or revoke your access to the Service at any time, for any reason or no reason, with or without notice. You may terminate your account and these Terms at any time by following the account deletion process within the NEXT SHIFT APP, or by contacting customer service at tenhoplantao@gmail.com. It is your sole responsibility to export or save any USER content stored in the app prior to termination. NEXT SHIFT has no obligation to retain or provide access to any USER content after termination.

It is also established that, in the event of termination, there will be no refunds for any payments made by the USER to NEXT SHIFT.

11. Applicable Law

These terms and conditions are governed by and interpreted in accordance with the laws of the Federative Republic of Brazil, and the USER irrevocably and exclusively submits to the jurisdiction of the courts of São Paulo, the capital of the State of São Paulo.
